1. Acceptance of These Terms

This website, digestivecarear.com (the “Site”), is operated by Digestive Care, P.A. (“we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms of Service (the “Terms”). If you do not agree, please do not use the Site.

These Terms apply to your use of the Site only. They do not govern the treatment relationship between you and any physician, advanced practice provider, facility, or other health care provider. That relationship is governed by the consents, agreements, and financial policies you sign at the time of service.

Digestive Care, P.A.; Arkansas Surgery & Endoscopy Center, LLC; Central Arkansas Surgical Center; and ASC Anesthesia, PLLC are separate organizations. Information about any of them appearing on the Site is provided for your convenience and does not make them a single entity or make one responsible for another.

2. The Site Does Not Provide Medical Advice

The content on this Site — including descriptions of conditions, procedures, screening guidance, preparation instructions, and answers to frequently asked questions — is provided for general informational and educational purposes only. It is not medical advice, and it is not a substitute for diagnosis, treatment, or advice from a qualified health care provider who has evaluated you.

Never disregard professional medical advice or delay seeking it because of something you read on this Site. Always consult your physician or another qualified provider with questions about a medical condition, symptom, medication, or procedure.

Screening recommendations, preparation instructions, and similar guidance described on the Site are general. Your provider may give you different instructions based on your individual history and risk factors. Follow the instructions your provider gives you.

3. No Provider-Patient Relationship Is Created

Using this Site, reading its content, submitting a contact or appointment request form, downloading a form, or sending us an email does not create a physician-patient, provider-patient, or any other treatment relationship. A treatment relationship is established only when you are accepted as a patient and evaluated by a provider at one of our locations.

4. Medical Emergencies

Do not use this Site, the contact form, email, or any online tool for medical emergencies or urgent medical concerns. Messages sent through the Site are not monitored continuously and may not be reviewed outside normal business hours. If you are experiencing a medical emergency, call 911 or go to the nearest emergency department immediately.

5. Accuracy of Site Content

We make reasonable efforts to keep the Site accurate and current, but medical information, provider rosters, services, hours, locations, contact details, and insurance participation change over time. We do not warrant that Site content is complete, accurate, current, or error-free, and we may change or remove content at any time without notice.

5.1 Provider Information

Information about providers is presented for general reference. The appearance of a provider on the Site does not guarantee that the provider is currently practicing, is accepting new patients, holds privileges at a particular facility, participates in your health plan, or is available at any particular location. Please call the office to confirm before scheduling or seeking care.

5.2 Services and Locations

Not every service described on the Site is offered at every location or by every provider. Service availability, hours, and locations are subject to change.

5.3 Insurance and Payer Information

Any list of health plans or payers shown on the Site is provided for general reference only. It does not confirm that a particular plan, product, network, or benefit is accepted by every organization, provider, facility, or location, and it does not confirm that a particular service will be covered or that you will owe no out-of-pocket amount. Network participation changes and varies by organization, provider, and product line.

You are responsible for verifying benefits and network participation directly with your health plan before receiving services. Any benefit verification we perform as a courtesy is an estimate, is not a guarantee of payment, and does not bind your health plan.

6. Patient Statements and Testimonials

Any patient statements, testimonials, reviews, or comments displayed on the Site reflect the experience of the individual who provided them. Individual experiences and results vary. A testimonial is not a prediction, promise, or guarantee of any particular outcome, and it should not be relied on in deciding whether to seek care or which service to pursue.

7. Appointment Requests and Online Forms

Any appointment request, contact form, referral form, or new patient form submitted through the Site is a request only. It is not a confirmed appointment and does not reserve a date or time. An appointment is scheduled only when our staff contacts you and confirms it directly.

We make reasonable efforts to respond to submissions during normal business hours, but we do not guarantee that a submission will be received, reviewed, or responded to within any particular time. If your matter is time-sensitive, please call the office.

8. Electronic Communications and Message Security

Do not send protected health information, Social Security numbers, insurance identification numbers, financial account numbers, or other sensitive personal information through the Site contact form or by unencrypted email. Standard email and web forms are not secure. Information transmitted this way may be intercepted, and we cannot guarantee its confidentiality in transit.

If you choose to send information to us electronically anyway, you do so at your own risk and you accept the risks associated with unsecured transmission. To discuss medical information, please call the office or use the patient portal when it becomes available.

By submitting a form or sending us an email, you consent to receive a response from us by the same method or by telephone at the contact information you provide.

9. Patient Portal

Access to a patient portal, when made available, is subject to separate portal terms of use and any enrollment agreement presented at registration. If those terms conflict with these Terms, the portal terms control for portal use.

You are responsible for maintaining the confidentiality of your portal credentials and for all activity that occurs under your account. Do not share your credentials. Notify us promptly if you believe your account has been accessed without authorization.

10. Online Bill Payment

Online payment functions, when made available, may be provided through a third-party payment processor. Your use of that function is subject to the processor’s own terms and privacy policy in addition to these Terms. We do not store full payment card numbers on the Site.

You are responsible for ensuring that payment information you submit is accurate and that you are authorized to use the payment method. Posting of a payment to your account may not be immediate. A payment made online does not by itself resolve a billing dispute; please contact the billing office regarding any disputed charge.

11. Privacy

Our Notice of Privacy Practices describes how protected health information about you may be used and disclosed and your rights regarding that information. Our website privacy policy describes how we handle information collected through the Site itself, such as analytics and form submissions. Both documents are incorporated into these Terms by reference.

Information you submit through the Site that is not protected health information — for example, general questions unrelated to your care — is handled under the website privacy policy rather than the Notice of Privacy Practices.

12. Children

The Site is intended for use by adults. We do not knowingly collect personal information through the Site from children under 13. If you believe a child under 13 has submitted personal information through the Site, please contact us so that we can remove it.

A parent or legal guardian may use the Site on behalf of a minor patient where permitted by law.

13. Permitted Use and Prohibited Conduct

You may use the Site for lawful, personal, non-commercial purposes and for legitimate professional purposes such as submitting a patient referral. You agree not to:

• Use the Site in any way that violates applicable law or these Terms;
• Attempt to gain unauthorized access to the Site, any account, any server, or any connected system or network;
• Introduce malware, viruses, or other harmful code, or interfere with the operation or security of the Site;
• Use automated means to scrape, harvest, index, or copy Site content except as permitted by our robots file;
• Submit false, misleading, or fraudulent information, or impersonate another person;
• Submit another person’s personal or health information without authority to do so;
• Use the Site to transmit unsolicited commercial messages;
• Reproduce, republish, distribute, or create derivative works from Site content except as permitted in Section 14.

We may suspend or terminate your access to the Site at any time, without notice, for any reason, including suspected violation of these Terms.

14. Intellectual Property

The Site and its content — including text, graphics, logos, service marks, images, page layout, and design — are owned by us or our licensors and are protected by copyright, trademark, and other laws. Our names, logos, and marks may not be used without our prior written permission.

You may view and print Site content for personal, non-commercial reference, and you may print and use patient forms and referral forms for their intended purpose. All other use requires our written permission.

Third-party names, logos, and marks appearing on the Site are the property of their respective owners. Their appearance does not imply endorsement, sponsorship, or affiliation unless expressly stated.

15. Third-Party Links and Content

The Site may link to websites, resources, or services operated by third parties, including professional organizations, health plans, laboratories, and payment processors. We provide those links for convenience only. We do not control third-party sites, do not endorse their content, and are not responsible for their accuracy, availability, privacy practices, or security. Your use of a third-party site is at your own risk and is governed by that site’s own terms and privacy policy.

16. Site Availability

We do not guarantee that the Site will be available at all times, uninterrupted, or free of errors. We may modify, suspend, or discontinue any part of the Site at any time without notice. We are not liable for any unavailability of the Site or any loss resulting from it.

17. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SITE WILL BE SECURE, UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

THIS DISCLAIMER APPLIES TO YOUR USE OF THE SITE. IT DOES NOT LIMIT, WAIVE, OR DISCLAIM ANY DUTY OWED TO A PATIENT IN THE COURSE OF CLINICAL CARE.

18. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SITE, WHETHER BASED IN CONTRACT, TORT, STATUTE, OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

NOTHING IN THIS SECTION LIMITS LIABILITY FOR PROFESSIONAL NEGLIGENCE IN THE DELIVERY OF CLINICAL CARE, OR ANY OTHER LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

19. Indemnification

You agree to indemnify and hold us harmless from any claim, demand, loss, or expense, including reasonable attorneys’ fees, arising out of your misuse of the Site, your violation of these Terms, or your violation of any law or third-party right in connection with your use of the Site.

20. Nondiscrimination and Accessibility

We do not discriminate on the basis of race, color, national origin, age, disability, or sex in our health programs and activities.

We are working to make the Site accessible to people with disabilities. If you have difficulty accessing any part of the Site, or if you need assistance obtaining information from the Site in another format, please call (870) 534-5533 and we will assist you.

21. Changes to These Terms

We may update these Terms from time to time. The revised version takes effect when posted on the Site, and the “Last revised” date will be updated. Your continued use of the Site after a change takes effect means you accept the revised Terms. Please review these Terms periodically.

22. Governing Law and Venue

These Terms are governed by the laws of the State of Arkansas, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Jefferson County, Arkansas, and you consent to the jurisdiction of those courts.

23. General Provisions

23.1 Severability

If any provision of these Terms is held unenforceable, that provision will be modified to the minimum extent necessary or severed, and the remaining provisions will stay in full force.

23.2 No Waiver

Our failure to enforce any provision is not a waiver of our right to enforce it later.

23.3 Assignment

You may not assign your rights under these Terms. We may assign ours in connection with a merger, reorganization, or sale of assets.

23.4 Entire Agreement

These Terms, together with our website privacy policy and Notice of Privacy Practices, are the entire agreement between you and us regarding your use of the Site, and supersede any prior understanding on that subject. They do not supersede any consent, financial policy, or agreement you sign in connection with your care.

23.5 Headings

Headings are for convenience only and do not affect interpretation.
